Open Burning Regulations
§ 107-12. Open burning prohibited. [Added 10-21-1999 by Ord. No. 22-1999]
A. Except as otherwise provided by State Department of Environmental Protection Regulations, including N.J.A.C. 7:27-1 et seq., and consistent with N.J.A.C. 7:27-2.3 governing the open burning of refuse, open burning is hereby prohibited within the Township of Pemberton as follows:
(1) No person shall cause, suffer, allow or permit the disposal of rubbish, garbage, trade waste, buildings or structures by open burning.
(2) No person shall cause, suffer, allow or permit the disposal of fallen leaves by open burning.
(3) No person shall, cause, suffer, allow or permit the disposal of any type of plant by open burning.
(4) The provisions of this section shall not apply to open burning of refuse for training and research exercises in fire protection or prevention when conducted at a permanent facility or training center designed to be solely for such purposes on a continuing basis.
B. Consistent with N.J.A.C. 7:27-2.1, "open burning" means any fire from which the products of combustion are emitted directly into the open air, and are not designed to be directed through a stack or chimney.
C. Enforcement of this section shall be by the Chief of any Fire Department in the Township of Pemberton , in addition to any other official already permitted under law.
D. Any person, persons or agents of property owners violating the provisions of this section shall be punished by a fine of not more than $500 for each offense.
E. The provisions of this section are intended to be consistent with the New Jersey State Department of Environmental Protection's Regulations on Air Pollution Control, N.J.A.C. 7:27-1 et seq., and the New Jersey State Uniform Fire Safety Act, N.J.S.A. 52:27D-198 et seq.
